What is an Attorney?
An attorney is someone who conducts business with an individual or an establishment.

You must take note that your attorney can only represent you in court if he or she is a “defence attorney at law.” To become a certified defence attorney, they must have the same qualifications as a lawyer.

As you can imagine, this means that most defence lawyers have an extensive amount of experience defending their clients in the lead-up to a trial, but do not have nearly as much experience standing up in court during a trial.

In the United States and UK, there is nothing barring a defence lawyer from acting as a trial lawyer; in fact, there is nothing stopping a defendant from representing themselves through a trial, although this is actively discouraged.

What is a Défense Attorney?
A defence attorney is a lawyer who focuses on representing a client who has been charged with a crime, beginning with their arraignment where the official charges are read. From the arraignment on, a defence attorney will be with their client every step of the way, and will advise them on entering a plea, making statements during the pre-trial proceedings, and ultimately crafting a path forward to a positive or favourable outcome for their client.
Défense attorneys will handle negotiations with prosecutors and the judge during the pre-trial process in an attempt to reach a plea deal that works for both the prosecution and the defence.
In instances of first offenses, this could be a combination of a reduced sentence combined with community service, fines, drug testing, therapy, and more. Ultimately, the goal of your defence lawyer is to avoid going to trial so that you can retain a say in the matter.
Once your case goes to trial, the outcome is entirely up to the judge and jury.
What Is a Trial Lawyer?
If your case needs to go to trial, meaning you have gone through every step of the pre-trial and have still been unable to reach a resolution, then the next step is the actual trial.
This will involve a variety of additional steps that many defence lawyers may never need to go through during their career, including jury selection, cross-examining witnesses, and communicating a clear and strong argument under the high pressure of the trial atmosphere.
A trial is so different from all of the prior pre-trial steps that in many countries, such as Britain, defence and trial lawyers are considered entirely different (known as solicitors and barristers in the UK).
While there is no legal distinction between a trial lawyer and a defence attorney in the United States, any legal professional will tell you that there is a significant difference in duties and expertise between the two fields.

Now, traditionally, an defence attorney is a person that has graduated law school, passed the bar exam, and is licensed. A lawyer would be someone that has graduated law school but has not been admitted to practice.

Pre Court:
If you are alleged to have committed a road traffic offence, the police have 6 months from the date of the offence to lay a charge against you.
You will then be given an opportunity to attend a driver course if applicable or to accept a fixed penalty notice. If you do not accept either option or request a court hearing, you will receive a Single Justice Procedure letter from the court.
It is important that you respond to the Single Justice Procedure letter.
This letter will be sent out to you notifying you that you are to be changed with an offence.
You will have 21 days to respond to this letter. If you fail to respond to this letter with a plea, you will be convicted of the offence in your absence and either sentenced or if you are likely to be disqualified then your sentence will be adjourned for you to make representations against a disqualification.
It is important to ask for legal advice at the outset of your case, even at the roadside.
You have a right to have legal advice and the police will postpone any questioning if you request advice from a solicitor.

Civil justice system;
Our recommendation for the introduction of a registrar in courts responsible for proactively case managing disputes and exercising devolved procedural functions is being realised through the role of “authorised court and tribunal staff” in the Courts and Tribunals (Judiciary and Functions of Staff Act) 2018.
civil justice work has been instrumental in shaping the structural changes to the civil courts and tribunal estate being undertaken through HM Court and Tribunals Reform Programme.

Post Conviction:
In most driving cases points are awarded against the Licence. The accruement of 6 penalty points within the first two years of holding a driving licence can lead to the DVLA revoking that licence. If we are instructed at the outset we are able to make representations for alternative disposals such as driver courses being provided by the police.
Even if you have held your licence over two years, the accruement of 12 penalty points over a period of three years can lead to a disqualification of a minimum of 6 months. If you require a driving licence for your work or personal reasons, we can make representations on your behalf to avoid a disqualification by arguing exceptional hardship apply in your case.
