The  Department of Justice International Services has jurisdiction over the following categories of crimes under international law:

  • genocide, or the intention to destroy a national, ethnic, racial, or religious group in whole or in part;
  • war crimes, or heinous breaches of the laws of war, including the prohibitions placed by the Geneva Conventions’ on torture and attacks on civilian targets, such as schools or hospitals;
  • crimes against humanity, or the violations committed through large scale attacks against the civilian populations, or violations committed as part of large-scale attacks against civilian populations, including rape, slavery, torture, imprisonment and murder; and
  • crimes of aggression, or the use or threat of armed force by a State against the territorial integrity, sovereignty, or political independence of another State, or violations of the UN Charter.

  7. DOJ Justice Criminal Defence Attorney Lawyer with more than 8 years’ PQE and the hourly rates are £1000.00 pound a hour VAT included.
  8. DOJ Justice Defence Attorney Lawyer with a PQE for 12 years is specialised in all laws and the hourly rates are £3000.00 pound a hour VAT included.

Ten key facts about the legal process:

In furtherance to the key features that are listed above, some of the basics are as follows:

  1. The Department of Justice International Services does not prosecute those who are under the age of eighteen years when a crime was committed.
  2. Before a prosecutor can investigate, a preliminary examination must be conducted considering the matters such as jurisdiction, gravity, complementarity, sufficient evidence and the interests of justice.
  3. While investigating, the Prosecutor must disclose and collect both incriminating and exonerating evidence.
  4. The defendant would be considered innocent until he/she is proven guilty. The onus of proof lies with the Prosecutor.
  5. During all stages of proceedings, that is, Pre-Trial, Trial and Appeals, it is the duty of the prosecutor that the defendant should be given all the information related to the case in a language he or she understands fully; thus the Department of Justice International Services proceedings are conducted in multiple languages, with teams of interpreters and translators at work.
  6. Pre-Trial judges may issue warrants of arrest and have to ensure that there is enough evidence available so as to send a case for trial.
  7. During the Pre-Trial phase, (before a case is committed to trial) the defendant is referred to as a suspect and not as an accused. Once the case reaches its trial stage, the defendant would be referred to as the accused as at that point the charges have been confirmed. 
  8. Trial judges hear the evidence from the defence, the Prosecutor and the victims’ lawyers, render a verdict, and sentence and decision on reparations if a person is found guilty. 
  9. Judges who hear appeals render decisions on appeals from the defence or Prosecutor. 

          A case which has been closed without a verdict of guilty can be reopened if the prosecutor brings on record new evidence.

How are an Defence Attorney and Lawyer Different?

As you may have noticed, the terms lawyer and defence attorney are often used interchangeably. This might seem confusing to you, and you may be wondering whether it is appropriate to use both labels to refer to the same type of legal professional.                         

Now, traditionally, an defence attorney is a person that has graduated law school, passed the bar exam, and is licensed. A lawyer would be someone that has graduated law school but has not been admitted to practice.

Which is higher lawyer or attorney?

A lawyer is an individual who has earned a law degree or Juris Doctor (JD) from a law school. The person is educated in the law, but is not licensed to practice law in another state. An defence attorney is an individual who has a law degree and has been admitted to practice law in one or more states.

Are all lawyers defence attorneys?

It is helpful to remember that all defence attorneys are lawyers, but not all lawyers are defence attorneys. The major difference is that attorneys can represent clients in court and other legal proceedings, while lawyers cannot. 

Road Traffic Offences:

​At DOJ Justice EK Courts  we understand that Road Traffic Law is very complex with far reaching consequences therefore have a dedicated team who specialise in this area, we are pro-active in fighting every clients cases often challenging technical evidence and presenting the best arguments avoiding fines, points or a disqualification.

We regularly represent professional drivers in relation to allegations made by the police in relation to driving allegations and also vehicle imperfections. 

Pre Court:

​If you are alleged to have committed a road traffic offence, the police have 6 months from the date of the offence to lay a charge against you. 

 

You will then be given an opportunity to attend a driver course if applicable or to accept a fixed penalty notice. If you do not accept either option or request a court hearing, you will receive a Single Justice Procedure letter from the court. 

 

It is important that you respond to the Single Justice Procedure letter. This letter will be sent out to you notifying you that you are to be changed with an offence. You will have 21 days to respond to this letter. If you fail to respond to this letter with a plea, you will be convicted of the offence in your absence and either sentenced or if you are likely to be disqualified then your sentence will be adjourned for you to make representations against a disqualification. 

It is important to ask for legal advice at the outset of your case, even at the roadside. You have a right to have legal advice and the police will postpone any questioning if you request advice from a solicitor. We can obtain the facts of the case and advice you if you have any defences available at law. 

Post Conviction: 

​In most driving cases points are awarded against the Licence. The accruement of 6 penalty points within the first two years of holding a driving licence can lead to the DVLA revoking that licence. If we are instructed at the outset we are able to make representations for alternative disposals such as driver courses being provided by the police. 

Even if you have held your licence over two years, the accruement of 12 penalty points over a period of three years can lead to a disqualification of a minimum of 6 months. If you require a driving licence for your work or personal reasons, we can make representations on your behalf to avoid a disqualification by arguing exceptional hardship apply in your case.
