As you may have noticed, the terms lawyer and defence attorney are often used interchangeably. This might seem confusing to you, and you may be wondering whether it is appropriate to use both labels to refer to the same type of legal professional.

Arrested:
If you are arrested in England or Wales at any time or day, you can simply ask to be represented by our firm and we will be contacted by the police station. It is important to know that you do not need to memorise our details or number and only have to provide the police the name of our firm and the police will contact us to represent you.
There is a common misconception that if you ask for a solicitor there will be a delay and you will be released quicker if you opt to go without a solicitor. This is not the case and having a solicitor will usually make the process faster as our team will ensure that officers are dealing with your enquiries with due diligence and expedition and that you are interviewed as soon as practicable.
Not Arrested:
If you are aware that the police are wanting to speak to you, we can contact the relevant department and arrange for the interview to be conducted on a voluntary basis where possible.
If this is not possible, then we will arrange a convenient time for you to surrender yourself to the police to be interviewed for the offence. We can obtain pre interview disclosure before the interview and have a private consultation with you prior to the interview taking place.
Illegal Arrest:
If you have been illegally arrested, or your property has been seized illegally we can take legal action against the investigators. If our action is successful you will be entitled to compensation and the return of the seized items.
Released on Bail:
If you have been arrested and released on bail pending police enquiries, it is not too late to have legal representation. The police and other regulatory or investigatory bodies usually attend court without notice and obtain a warrant to enter and search your property. EK-v-A&A – Conspiracy to travel abroad to attend a place used for terrorist training and collecting and possessing information likely to be useful to a person committing or preparing an act of terrorism contrary to section 58 of the Terrorism Act 2000.
Actions against the Police
The police are governed by strict rules and procedures and if their actions fall foul of these rules, you may have a claim for compensation. Our DOJ Justice EK Attorney Lawyer has successfully obtained apologies and also compensation for our clients from a number of different police forces, after taking actions against the police.

The police returned our clients vehicles until the case is being investigated by the police.
EK -v-West Yorkshire Police - Successful challenge against the legality of a search warrant issued at Bradford Magistrates Court. The Police accepted liability and our clients vehicle was dropped off to his garage by the police.
EK -v-The Metropolitan Police– Successful challenge against the legality of a search warrant issued at Bradford Magistrates Court. The Police accepted liability and all seized items including, Designer handbags, computer equipment, and financial documents were all returned to our client. Our client was also paid compensation and we recovered our legal costs.
EK -v- Bradford Magistrates Court – CJ was released with bail conditions including a curfew with doorstep conditions. An application was made before the Magistrates court to vary his bail address. This was granted. The Police arrested CJ a few days later stating that he has breached his bail by not residing at his bail address- which had not been updated on the court/police systems.
Bradford Magistrates accepted liability and our client received £3000 compensation and we received a contribution towards our legal costs.
